1. When is this privacy policy applicable?
This privacy policy applies to all data we collect, use, and store from our customers and other users of our platform and environment.
There is one exception: on the platform and environment, you may find links to third-party (mobile) websites. For the processing of your data via these websites, those third parties are responsible themselves, so the privacy policy of De Fabrikrant® does not apply to them.
2. Who is De Fabrikrant®?
De Fabrikrant is a platform where you can find, order, and reserve the best deals, premieres, and dental training within seconds. All information directly from the manufacturer and readily available, right in your pocket.
De Fabrikrant® searches, collects, bundles, and disseminates information from manufacturers in one place. Your order, reservation, payment, and delivery always go through De Fabrikrant®.
De Fabrikrant® is the company that ensures the best deals and ensures that everything runs smoothly.

3. What data and information does De Fabrikrant collect and process?
When you use our platform and environment, we collect three types of data:
Data you provide to us This includes the information you provide when you sign up for the environment. For example, your email address, but also your address and phone number, so we know where to deliver your order and can contact you if necessary. Once you place an order, we also store your order information. Additionally, you provide data when you email our customer service.
Automatically generated data To ensure our environment functions properly, we also collect automatically generated information. This includes your IP address, the pages you visit in our environment and the duration, the browser you use, and its version number. We also track whether you read our emails and what you click on in those emails. This helps us make our emails better and more relevant.
Information from other sources Sometimes we combine information from public external sources (e.g., demographic and geographic data) with data from customer groups. This helps us tailor our offerings even better. Rest assured, we never use data that can directly identify you, such as your email address or phone number.

4. For what purposes do we process this data?
Your account
To use De Fabrikrant, you need an account. You can create an account through the environment. When you do, we ask for certain information. You are not required to fill in all the information, but the more complete the information you provide, the better we can tailor De Fabrikrant to you. To create an account, a valid email address, practice name, first and last name, postal code, house number, (mobile) phone number, BIG registration number, and Chamber of Commerce number are required. Without this information, we cannot serve you properly and you cannot create an account. We need your details, for example, to know where to deliver your orders and how to contact you. You can always update the information you provide to us.
Your use of the app and webshop
When you visit our environment, we use automatically generated usage information. We primarily do this to ensure the environment works properly. We may use software to measure and collect visit data, such as response times, errors, and interaction data (like scrolling and clicking behavior). We also use this data to secure De Fabrikrant.
Furthermore, we may use some of this data to personalize the environment based on your search and purchase behavior. This helps us tailor De Fabrikrant to you and assist you more personally. We use, for example, your previous orders, your IP address, and the browsing and search behavior stored with cookies. You can read more about this in our cookie policy.
Orders
When you order products through our environment and want them delivered, we use the data you provided when creating your account. This allows us to handle and deliver your order properly and contact you if necessary, for example, about the delivery time and the contents of your order. If you have set this up, we also send push notifications to your phone for specific matters.
We also use your order data for statistical research, for example, to see which products sell well and which do not. In such analyses, we always use your data only at an aggregated level.
Finally, we use data about your order behavior and the frequency with which you order certain products to tailor De Fabrikrant to you. This helps you find the deals you are looking for more quickly, and we can offer promotions that are truly interesting to you. To provide these functions, we store your previous orders. To determine the order, we look at how often you buy a particular product and at what time.
Reviews
After your order is delivered, we regularly ask via email if everything was satisfactory. This helps us assist you more quickly if you have a complaint. It also helps us determine how we can further improve our service. You decide whether to participate and what information you provide. The information you provide is stored. If necessary, we use your data to respond to your feedback.
Promotions
For future special promotions, we may need additional information from you. This information will then be linked to your account so that you can participate in the special promotion.
Contact
If you contact our customer service, we store your contact details and your question or complaint. The information we collect is used to respond to your question or complaint and for general statistics.
Product recall
If one of our manufacturers wants to recall a product from the market (e.g., for safety reasons), we can use your order information and data to inform you.
Abuse and fraud
We hope it never happens, but in exceptional circumstances, we may temporarily or permanently block or delete your
De Fabrikrant account. This would only occur in cases of severe misconduct, such as abuse of our services, fraud, or repeated failure to pay on time. In such cases, we store your name, email address, and IP address to prevent it from happening again. Only if absolutely necessary, we share customer data with the government.
Newsletters, emails, and other messages When creating an account or through your settings, you can indicate whether we may communicate with you about our products and services. If you have given permission, we use your contact details to send you messages via email, push notifications, or SMS.
We may also use your data to personalize such communications. For example, to offer you promotions that are interesting to you. If you no longer wish to receive emails, you can unsubscribe at the bottom of each email. Besides communicating digitally about our products and services, we also use your data to evaluate how our marketing messages perform. We may use information collected through cookies for this analysis. We look at how often our emails are opened and how many people click on a button.
5. What are the legal grounds for using my data?
Here comes a bit of legal jargon. If this doesn't concern you, feel free to skip this section. In section 4, we have already explained everything you need to know about the purposes for processing your data.
We process your data based on the following "legal" grounds: your consent (which you can withdraw at any time), necessity for the performance of a contract with you or pre-contractual arrangements (such as using your email address to confirm an order), and the "legitimate interests" of
De Fabrikrant or a third party. We may also have a legal obligation to process your data, for example, when we suspect fraud.
When we process your data based on a "legitimate interest," we believe that the interests of De Fabrikrant or a third party justify such processing. Of course, we will take reasonable steps to ensure that other balanced interests (such as your privacy) are not unnecessarily harmed. "Legitimate interest" is, for example, the legal basis for our analysis of responses to promotions, to improve our services and direct marketing. You can read extensively in section 4 how we use your information for this purpose. Another example of processing based on "legitimate interest" is processing to secure our environment.

6. What about cookies?
Like almost all other websites, De Fabrikrant's environment uses cookies. We use functional, analytical, and tracking cookies. Cookies are small information files that your computer or mobile device stores when you use a website or app.
Many cookies ensure that you can use a website properly. For example, thanks to cookies, you don't have to log in repeatedly or download the same information each time you visit a website. Other cookies help to see how a website is used or to communicate with users in a targeted manner.
By using De Fabrikrant's environment, cookies can be placed on your device, and access to those cookies can be obtained. De Fabrikrant's cookies cannot damage your computer, phone, tablet, or the files on it.
First and foremost: De Fabrikrant works fine if you choose not to accept any cookies. We only place and use advertising cookies if you have given permission. Whether you do so is entirely up to you. However, we can make De Fabrikrant more user-friendly if you accept them.
During your first visit to our environment, we informed you about these cookies and asked for your consent to place them. You can opt out of cookies by setting your internet browser to no longer store cookies. Additionally, you can also delete all previously stored information via your browser or mobile phone settings.
7. Which third parties have access to my data?
Your private data remains private. This means we only share your personal information without your permission in special cases. The only parties we will share data with without your consent are:
Manufacturers and course/event organizers To process the payment and delivery of your orders, we work closely with manufacturers. We also share information with course and event organizers.
Subcontractors and service providers we trust With these parties, we will always make detailed agreements on how to protect your privacy and that of other customers.
A party that wants to acquire or merge with us In the highly unlikely event that this ever happens.
Supervisors, tax authorities, or law enforcement agencies If we believe we are required to do so based on laws or regulations.
The court and opposing parties in a lawsuit If your data is important as evidence.
Even if your personal data is transferred to countries outside the European Union, we ensure that your privacy is protected as much as possible. We work, for example, with European model contracts specially designed for such cases.
8. How do you secure my data?
We find it important that your information is securely stored. Therefore, we have taken serious technical and organizational measures to secure your data against loss or any form of unlawful processing. We secure our systems and applications according to current information security standards.
9. How long do you keep my data?
We do not keep your data longer than necessary. For example, we do not keep complaints (and the associated contact details) for more than two years, unless the nature of the complaint requires a longer retention. If you have a question about the exact retention period of certain types of data, feel free to email privacy@defabrikrant.nl.
10. How do you handle data from minors?
To create a De Fabrikrant account and order products through the environment, you must be 18 years or older. Therefore, we do not collect data from individuals under 18 for processing that requires consent.
11. How can I view, modify, correct, or delete my data?
Of course, you remain in control of your own data. Therefore, you can request access to the information we have stored and use about you at any time. You can also always modify or delete data. Finally, you also have the right to object to our data processing.
When you make a request or exercise your right to object, we ask you to send a valid ID proof. This ensures it is really you, preventing someone else from accessing your data. For security, make your BSN number unreadable and your photo unrecognizable.

12. Can this privacy policy be changed?
This privacy policy can indeed change, for example, due to new laws or regulations. The latest, current version of the privacy policy can always be found at fabrikant.defabrikrant.nl. There we also always state the latest change date. If we make changes to our policy that are important to you, we will also inform you in other ways (e.g., via email or in the environment).
